This Privacy Policy (“Policy”), made available and maintained by PASCO, a private legal entity located at Rua Dos Três Irmãos, 201, Vila Progredior, in São Paulo, São Paulo, ZIP Code 05615-190, registered with the CNPJ under number 50.851.205/0001-59, is intended to inform the User (“user,” “users,” or “you”) about what information is collected from our website https://pasco.com.br/ and other related pages (“website” or “site”) and describes the practices and procedures adopted by Pasco for the collection, storage, use, processing, sharing, and deletion of information obtained from users.

The user hereby declares that he or she is at least 18 (eighteen) years of age and has read this document in its entirety and carefully, is fully aware of its contents, and thereby gives his or her free, express, and informed consent to the terms set forth herein. If the user does not agree with this Privacy Policy, he or she must discontinue access to the website and services provided by Pasco.

1. Application of This Policy 

We make our website available to the general public to provide information about our services and how to sign up for them; to offer free content; to allow you to subscribe to our newsletter; to promote products, events, and other materials produced by Pasco or our partners; and to create a channel of communication between you and Pasco.

This Policy applies to the processing of personal data by Pasco in order to provide its Services and make the website available. For clarity, personal data is any information that can directly or indirectly identify an individual, such as their name, phone number, IP address, and email address (“Personal Data”).

You will be deemed to have accepted this Policy when you access our website and/or use our services, even if they are free of charge. This indicates that you are aware of and fully agree with how we will use your information and data.

 

2. Information Collected

Pasco will collect (a) data that the website user voluntarily provides and (b) access logs and information generated when the user accesses the Pasco website (collectively, the “Information”). The amount and type of information collected by Pasco vary depending on the context and the type of service or content the user is seeking on the website.

 

2.1 Pasco states that it collects and processes data through the following means:

 (a)  Data voluntarily provided by the user: to use a feature of the website, such as signing up to receive the newsletter, accessing and commenting on content, or receiving information about our services and/or contracting them. Pasco collects and processes users’ personal data through forms filled out on the website or via chat on the website itself, as necessary, such as name, email address, phone number, company, job title, number of employees, and/or your company’s business processes. Occasionally, Pasco may request certain information by contacting users directly via email or phone;

(b) Website browsing information: Pasco may collect and process certain technical data about the user and their interaction with the website, such as URL information, cookie data, the user’s IP address, geolocation, the type of device used to access the website, device identification, device attributes, type of network connection (e.g., Wi-Fi, 3G, LTE, Bluetooth), network provider, network and device performance, browser type, language, visit duration, and pages visited. Pasco may also store information regarding all past interactions with our users, such as pages accessed, content downloaded from our pages, and email interactions.

 

2.3 We are not responsible for the accuracy, truthfulness, or lack thereof in the information that the user provides to Pasco, nor for any outdated information; it is the user’s responsibility to provide accurate information or to update it.

Pasco will process the data collected as described in item 2 above in accordance with Brazilian data protection laws and strictly for the purpose of:

(a) to provide, personalize, and improve the user experience with the free Services offered by the website and other related pages, as well as with other services and products provided by Pasco (for example, by providing personalized, customized, or location- or interest-based services, recommendations, and features);

(b) to understand how users access and use the website, in order to ensure its technical functionality, develop new products and services, and analyze users’ use of the website, including their interaction with the content, products, and services that are made available, offered, or linked through the website;

(c) send notifications and alerts regarding the Services;

(d) send communications to the user, either directly or through partners, for the purposes of: marketing, research, participation in contests, quizzes, campaigns, and promotions via email, notifications, and ads on Google Ads and its partner networks, Bing and its partner networks and/or social media platforms (such as Facebook, Instagram, LinkedIn) or other messages, in accordance with any permissions the user may have provided (for example, by filling out the form to receive our newsletter); 

(e) provide the user with features, updates, pricing and service terms, advertising, or other content based on the user's location and specific interests.

(b) Pasco will use its best efforts to protect the privacy of user data. However, unfortunately, no website is completely secure, and Pasco cannot fully guarantee that all information transmitted through the website will not be subject to unauthorized access carried out through methods designed to improperly obtain information. For this reason, users should also take appropriate measures to protect their information.

 

6. Data Sharing and International Transfer

Pasco may share Personal Data collected from our website and related pages with partners and suppliers, such as data processing companies (operators), processing systems (cloud computing services), information technology consulting firms, telecommunications services, advertising and marketing services, and event organizers (such as, Google Ads, Google Analytics, Amazon Web Services, Intercom).

The services provided by suppliers and partners are governed by their own terms of use and privacy policies, over which Pasco has no control. It is the user’s responsibility to review these policies before using the website. If the user does not agree with the privacy policies followed by the suppliers, the user must refrain from using the website and any other services offered by Pasco.

The provision of certain services by suppliers and partners may require the international transfer of data. In such cases, Pasco undertakes, whenever possible, to contract for such services only with companies that are subject to the data protection rules set forth in Law No. 13,709/2018 and/or in legislation analogous to Brazilian law.

Pasco reserves the right to process and/or disclose any Personal Data and information to comply with a legal obligation or a court order, if requested to do so; to fulfill other agreements and/or contracts; and to protect the rights, property, or safety of Pasco, as well as those of our employees and/or customers.

 

7. Data Retention, Modification, and Deletion

The information collected by Pasco through the website will be retained only for as long as necessary to fulfill its intended purpose and will be automatically deleted from our servers after it has been used for the purposes for which it was collected. We will also take into account the amount, nature, and purpose of the processing, as well as the applicable legal requirements, to determine the retention period for such information.

The User, as the data subject, may at any time request a copy of their personal data processed by Aurum or request the correction and/or updating of their personal data, always by emailing DPO@Pasco.com.

The User, as the data subject, may also request at any time, via the email address provided above, that their personal data be anonymized, blocked, or deleted from Pasco’s database.

Please note that all the emails we send include a link to unsubscribe, located at the bottom of the page. When you click that link, you will be automatically removed from the mailing list.

If you fill out any form on our website again, your email address will be added to the list once more. Therefore, if you wish to unsubscribe, you will need to submit a new request.

Pasco reserves the right to retain any personal data necessary to comply with legal obligations, to meet regulatory requirements, to resolve disputes with users, to prevent fraud and misuse of the website and data, and/or to ensure compliance with this Privacy Policy.

 

8. Policy Changes

We are always striving to improve our processes, and for this reason, this Privacy Policy may be updated from time to time. We recommend that you review our Privacy Policy periodically. However, Pasco may notify users of relevant changes through a notice on the website itself, by email, or by other reasonable means.


9. Governing Law

This Privacy Policy shall be governed by and interpreted in accordance with Brazilian law, regardless of the laws of other states or countries. All personal information regarding Users who access and use the Pasco website is handled in accordance with Law 12.965/2014 (Brazilian Framework for the Internet) and Law 13.709/18 (General Personal Data Protection Law).

The courts of the District of São Paulo, SP, are hereby designated as the forum for resolving any dispute or controversy involving this document, unless otherwise specifically provided for by applicable law regarding personal, territorial, or functional jurisdiction.
